The terms and conditions governing your use of Site Gate Check.

By downloading, installing, or using Site Gate Check ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
The App is operated by SiteLine Datum ("we", "us", "our"). These Terms constitute a legally binding agreement between you and SiteLine Datum.
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
Site Gate Check is a vehicle compliance inspection application designed for use on UK construction sites. The App enables users to conduct and record vehicle gate inspections, aligned with the CLOCS (Construction Logistics and Community Safety) standard.
Key features include DVLA vehicle lookups, nonconformance reporting, flagged vehicle alerts, route mapping, PDF report generation, CSV data export, and multi-gate project sharing between team members.
Site Gate Check is a tool to assist with vehicle compliance inspections. It is not a substitute for professional health and safety advice, and does not guarantee compliance with any specific regulatory requirement. Users remain responsible for ensuring their own compliance with all applicable legislation and site safety requirements.
The App is intended for use by construction industry professionals aged 16 and over. By using the App, you confirm that you meet this requirement.
You must have a valid Apple ID and an iPhone or iPad running a supported version of iOS/iPadOS to use the App.
The App uses your Apple iCloud account for authentication and data storage. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account.
When using shared projects, the project administrator controls access. The administrator is responsible for approving join requests and managing participants. If you are a gatekeeper, your access to shared project data is granted by and subject to the administrator's approval.
New users receive 20 free inspections with no sign-up or payment required. Once free inspections are used, a paid plan is required to continue conducting inspections.
The App offers two tiers — Admin and Gatekeeper — available as monthly auto-renewing subscriptions or one-time time packs (1, 3, or 6 months). Current pricing is displayed in the App and on our pricing page.
All purchases are processed by Apple through the App Store and are subject to Apple's terms and conditions. We do not process or store any payment information.
Monthly subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your iPhone Settings under Subscriptions.
Time packs are one-time purchases that expire at the end of the purchased period. They do not renew automatically.
Refund requests are handled by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support.
We reserve the right to change subscription prices. Any price changes will be communicated in advance through the App Store, and existing subscribers will be notified before their next renewal.
You agree to use the App only for its intended purpose of vehicle compliance inspections on construction sites. You must not:
You retain ownership of all inspection data, photographs, and content you create using the App. By using the App, you grant us a limited licence to process this data solely for the purpose of providing the App's features, including:
You are responsible for ensuring you have the necessary authority and any required consents to collect and process the personal data entered during inspections (such as driver names and photographs), in accordance with applicable data protection legislation.
Important: We do not back up your data beyond what Apple's iCloud service provides. You are responsible for maintaining your own backups. We recommend retaining PDF reports and CSV exports as part of your audit trail.
The App queries the DVLA Vehicle Enquiry Service to retrieve vehicle technical data based on registration numbers you enter. This data is provided by the DVLA and is subject to their terms of use.
We do not guarantee the accuracy, completeness, or availability of DVLA data. The DVLA service may be unavailable at times due to maintenance or other factors beyond our control. Vehicle data should be verified independently where critical decisions depend on it.
The App's NCR feature allows you to flag compliance issues and send notification emails to configured project contacts. You are responsible for:
NCR emails are sent via Brevo and delivered on a best-effort basis. We do not guarantee email delivery and are not liable for any consequences arising from delayed or undelivered NCR notifications.
Project administrators who enable sharing are responsible for:
Gatekeepers who join shared projects are responsible for conducting inspections accurately and in accordance with their employer's procedures and applicable site safety requirements.
We are not responsible for disputes between project administrators and gatekeepers, or for any misuse of shared project data by authorised participants.
The App, including its design, code, features, branding, logos, and documentation, is the intellectual property of SiteLine Datum and is protected by copyright and other intellectual property laws.
Your use of the App does not grant you any ownership rights in the App or its intellectual property. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App in accordance with these Terms.
The "Site Gate Check" name, app icon, and associated branding are trademarks of SiteLine Datum. You may not use these without our prior written consent.
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The App is designed to assist with vehicle compliance inspections but does not guarantee compliance with CLOCS, CDM Regulations, or any other standard or legislation. Users are responsible for understanding and meeting their own compliance obligations. The App should be used as part of a broader site safety management system, not as a standalone compliance solution.
We do not guarantee uninterrupted or error-free operation of the App. Features that depend on internet connectivity (DVLA lookups, CloudKit sync, NCR emails, route mapping) may be temporarily unavailable. The App includes offline functionality to mitigate this, but some features require a connection.
The App relies on third-party services including Apple iCloud, Apple CloudKit, DVLA, Apple MapKit, and Brevo. We are not responsible for the availability, accuracy, or performance of these services.
To the maximum extent permitted by law, SiteLine Datum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App.
Our total aggregate liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.
You agree to indemnify and hold harmless SiteLine Datum from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
You may stop using the App at any time by deleting it from your device. Deleting the App does not automatically cancel any active subscriptions — you must cancel these separately through your iPhone Settings.
We reserve the right to suspend or terminate your access to the App at any time if we reasonably believe you have violated these Terms, without prior notice and without liability.
Upon termination, your right to use the App ceases. Any inspection data stored locally on your device remains accessible until you delete the App. PDF reports in iCloud Drive remain until you delete them.
We may update, modify, or discontinue features of the App at any time. We will endeavour to provide notice of significant changes through app updates or our website, but are not obligated to do so.
Continued use of the App following any changes constitutes your acceptance of those changes.
These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SiteLine Datum regarding your use of the App, and supersede any prior agreements or understandings.
